Terms and Conditions – Visiblo Photography Services

These Terms and Conditions (“Agreement”) govern the provision of photography and digital services by Visiblo (“Provider”, “we”, “us”, or “our”) to the client (“Client”, “you”, or “your”). By booking any service with us, you agree to the following terms.

1. Services Provided

We offer the following services:

  • Google Business View Photography

  • 3D Virtual Tours (e.g., Matterport)

  • 2D & 3D Floor Plans

  • Directory Citation Services

  • Add-on Digital Marketing Packages

2. Matterport Website Embedding Subscription

If you wish to embed your Matterport 3D virtual tour on your own website:

  • A £15 per month subscription is required to cover hosting and maintenance costs.

  • This fee is recurring and applies as long as the embed remains active.

  • Non-payment or cancellation of the subscription will result in removal of the Matterport embed from your website without further notice.

3. Booking & Payment Terms

  • A deposit is required to secure all bookings. The specific amount will be communicated during the booking process.

  • If you pay less than 100% upfront, you agree and are legally bound to pay the remaining balance (100%) immediately upon completion of the photoshoot.

  • Once services are completed and published (e.g., added to your Google Business Profile), full payment is required, regardless of subjective satisfaction.

  • Final assets will not be released or linked until the balance is paid in full.

4. Delivery & Turnaround

  • We aim to deliver photos, tours, and other assets within 14 business days after the shoot.

  • Timeframes may vary depending on the project scope and complexity.

5. Cancellations & Rescheduling

  • Cancellations must be made at least 48 hours before the scheduled shoot.

  • Deposits are non-refundable, except in cases where cancellation is due to our fault or an unavoidable event.

  • Clients may reschedule once without penalty with at least 48 hours’ notice.

6. Usage Rights & Ownership

  • All imagery submitted to Google Street View is subject to Google’s terms and ownership policies. We do not retain or grant copyright over this imagery. Hosting, visibility, and availability are fully controlled by Google.

  • Matterport 3D tours are hosted on the Matterport platform and subject to Matterport Inc.’s licensing terms. The platform retains ownership of the 3D assets.

  • You are granted a license to view, share, or embed the Matterport tour while your subscription remains active.

  • You may not alter, resell, distribute, or otherwise reuse the media outside of the original project scope without express written permission.

  • We reserve the right to use watermarked excerpts or images for our own portfolio and marketing purposes, unless otherwise agreed in writing.

7. Third-Party Hosting Disclaimer

  • We are not responsible for any removal, technical errors, downtime, or policy actions taken by Google or Matterport.

  • If your content is removed, modified, or made inaccessible by these platforms, we are not liable and no refunds will be issued.

  • If content must be recreated due to third-party action, additional charges may apply.

8. Client Responsibilities

  • The Client must ensure the property or premises are prepared and accessible at the time of the scheduled shoot.

  • The Client is responsible for obtaining all necessary permissions or access to the site.

  • Any delays caused by the Client may result in additional charges or rescheduling fees.

9. Limitation of Liability

  • We are not liable for:

    • Loss of business or income due to delays

    • Third-party platform outages or removals

    • Inaccuracies caused by incomplete information or poor site readiness

  • Our total liability shall not exceed the total amount paid for the service in question.

10. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By booking our services or accepting delivery of content, you confirm that you have read, understood, and agreed to these Terms and Conditions.
